Terms and Conditions of Booking

TERMS AND CONDITIONS OF BOOKING. We endeavour to ensure that all our customers have complete satisfaction no matter what their requirements are. It should, however, be understood that we are acting on behalf of the supplier of the travel product specified and that all bookings are accepted on the following conditions:-

Holiday Hut Ltd endeavours to ensure that all our customers have complete satisfaction no matter what their requirements are.

 

Unless specified as the operator, Holiday Hut Ltd acts as a retail agent for ATOL Holders and other Principals. All holidays are also subject to the terms and conditions as set out in the tour operators booking conditions. These booking conditions can be found in the individual tour operator’s literature.

 

It should be understood that we are acting on behalf of the supplier of the travel product specified and that all bookings are accepted on the following conditions:-

 

DEFINITIONS

 

“Package holiday" means the pre-arranged combination of at least two of the following components when sold or offered for sale at an inclusive price and when the service covers a period of more than twenty-four hours or includes overnight accommodation:—

 

(a)  transport;

 

(b)  accommodation;

 

(c)  other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package,

 

And

 

(i)  the submission of separate accounts for different components shall not cause the arrangements to be other than a package;

 

(ii)  the fact that a combination is arranged at the request of the consumer and in accordance with his specific instructions (whether modified or not) shall not of itself cause it to be treated as other than pre-arranged;

 

"Travel product" means packages and any other travel related products including (without limitation) flight, rail and coach tickets and insurance;

 

"Operator" means any person who organises travel products and sells them or offers them for sale through Holiday Hut Ltd

 

“Principal” means any person who designates another (the agent) to act on his or her behalf.

 

Words denoting the singular include the plural.

 

1. LIABILITY

We act on behalf of the tour operator in connection with the sale of their travel products. Accordingly, there is no direct contractual relationship between you on the one hand and us on the other hand. All bookings accepted by us and arrangements made by us are subject to the terms and conditions of the operator concerned and we have no direct contractual liability to you in connection with the travel product specified except as may be imposed by law.

 

2. PAYMENT

Bookings made within ten weeks of the scheduled date must be accompanied by full payment. If full payment is not received by the due date, we reserve the right to treat your booking as cancelled, and you would incur cancellation charges, which could be up to 100% of the value of the booking. Bookings made outside 10 weeks of departure may be secured by paying a deposit per person. The amount of deposit payable may vary and will be advised to you by the consultant at the time of booking. All deposits are non-refundable, unless in the event that travel arrangements are unavailable. Holiday Hut Ltd does not accept responsibility for any travel or accommodation arrangements made by you before you have received final confirmation of your booking.

 

 

3. CANCELLATION

In the event that you do not pay for the travel product specified within the time limits specified by the operator concerned we reserve the right on our own behalf and the operator to cancel your booking of the travel product on your behalf, or not to confirm the final booking with the operator, in either case without further notification to you. If this occurs then the initial deposit will not be refundable and the balance of any further money paid by you for the travel product will be dealt with in accordance with the operator's terms and conditions and any applicable law.

 

4. REMINDERS

The receipt/invoice is your final account and no further reminder regarding payment will be sent.

 

5. OBLIGATIONS

Holiday Hut Ltd has done its best to ensure that the statements made in its web sites & brochure are correct, and we do our utmost to ensure that the holidays offered are properly arranged and that services, accommodation, car hire and organisations used are reputable. Nevertheless arrangements have to be made substantially in advance and difficulties can, occasionally arise. Accordingly, while Holiday Hut Ltd accepts liability for any loss you may suffer as a direct result of negligence of our employees, we do not accept liability for events, or the acts or omissions of people, outside our control, if you are unfortunate enough to suffer any such problems your holiday insurance may provide a measure of compensation.

6. PRICING

All prices quoted are in pounds sterling. Our suppliers reserve the right to amend prices due to currency fluctuations, fuel surcharges, government action or hotel rate increases. Prices do not include, unless stated in writing, any tips or porterage of luggage at any airport or hotel, airport or departure taxes, hotel laundry expenses, meals, beverages, entrance fees, guide fees, city sightseeing tours fees, excursion fees, telephone calls and any items that are offered by the hotel, including the contents of room mini-bars or any other items not detailed on the hotel voucher.

 

7. HOLIDAY INSURANCE

You must take out holiday insurance providing adequate cover for your trip. Your attention is drawn to the fact that some of the circumstances, which might necessitate you cancelling your holiday, are ones that would entitle you to make a claim under the insurance. In such situations this would pay for the cancellation charges that Holiday Hut Ltd would be entitled to charge under terms set by the tour operator. Motor insurance is compulsory and is included in the price of the car hire but is not included as separate cover in the standard holiday insurance. Any non standard motor insurance should be notified in writing to use by the client, at an additional cost. Travel insurance must be purchased within 14 days of confirming your booking with The Company.

 

8. DESCRIPTIONS

Descriptions are drawn from information provided directly by the Hotel and or Tour Operator. Holiday Hut Ltd cannot be held responsible for any inaccuracies in such information, nor can liability be accepted for changes in facilities, which are not advised to us by the Hotel. Particular features or facilities in hotel descriptions form part of the hotel’s standard offering and their availability can not be guaranteed unless specifically requested by the client and confirmed by Holiday Hut Ltd in writing.

 

9. PASSPORTS AND VISAS

 

The lead passenger is responsible in ensuring that all passengers have valid passports and any visas that may be required. Certain destinations may require at least six month's validity remaining on the passport on the date of return. If you have questions with regards to this please contact the local embassy of the country/countries that you are planning to visit.

 

It is also the lead passenger’s responsibility to ensure that all members of their party have all the health vaccinations for the travel being undertaken.

 

We may offer travel to destinations deemed to be of a higher risk by The Foreign and Commonwealth Office. By acting as agents to tour operators offering these destinations we are not declaring that travel to these destinations is advisable or without any risk. We cannot be held responsible for any damages or losses that may result from travelling to these destinations.

 

10. GOVERNING LAW
These Terms and Conditions shall be governed by, and construed in accordance with, the laws of England. All disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the English Courts.
